Your Consumer Rights
Understanding your rights under federal law.
Tesla Hatcher LLC is committed to treating all consumers fairly and in compliance with all applicable laws. We want you to understand your rights under the Fair Debt Collection Practices Act (FDCPA) and other consumer protection laws.
Fair Debt Collection Practices Act (FDCPA)
The FDCPA protects you from abusive, unfair, or deceptive practices by debt collectors. Below are some of your key rights.
Right to verification
Within five days of first contacting you, we must send a written notice with the amount of the debt, the name of the creditor, and a statement of your right to dispute. If you dispute in writing within 30 days, we must stop collection until we provide verification.
Right to dispute
You have 30 days from the initial notice to dispute the debt in writing. We must cease collection until we obtain and mail you verification of the debt.
Right to original creditor info
You may request the name and address of the original creditor if different from the current creditor. We must provide this information in writing.
Right to stop contact
If you send a written request asking us to stop contacting you, we must honor it. We may only contact you to confirm we are stopping or to notify you of specific actions.
Protection from harassment
Debt collectors cannot harass, oppress, or abuse you — including threats, obscene language, or repeated calls intended to annoy.
Protection from false statements
Debt collectors cannot lie or make false representations — such as falsely claiming to be attorneys or threatening actions they cannot legally take.
Protection from unfair practices
Collectors cannot use unfair means — such as collecting amounts not authorized, depositing post-dated checks early, or making you accept collect calls.
Restrictions on contact
We cannot contact you at unusual times (generally before 8 a.m. or after 9 p.m. local) or at places known to be inconvenient, including work if your employer disapproves.
